These Terms of Service (“Terms”) govern the use of services provided by Dominik Harazmus, conducting business under CEIDG, with its registered office at Katowicka 56/3, 40-174 Katowice, Poland (“Company”, “we”, “our”, “us”). 1. Services

We provide digital creative services, including but not limited to:

• Graphic design

• Paid thumbnail services

• Video editing services

• Subscription-based plans

2. Payments

All payments are processed securely via Stripe.

Prices are provided in USD or EUR, unless otherwise agreed.

Services are delivered after successful payment.

3. Paid Thumbnail Services

Delivered thumbnails include full commercial use rights.

Revisions are provided according to your purchased package.

Additional revisions or changes outside the agreed scope may require extra fees.

Discounts and bundles may be offered at our sole discretion.

Unused thumbnails from monthly plans expire at the end of each billing cycle and do not roll over.

4. Video Editing Services

Video editing is billed per minute of final edited footage.

Delivery times may vary depending on project complexity and client communication speed.

5. Refunds and Cancellations

Due to the digital and creative nature of our services, refunds are not guaranteed once the work has commenced.

Refund requests may be considered individually in case of non-delivery of the agreed service.

Subscription plans can be canceled at any time via our Customer Portal.

It is the client’s responsibility to manage and cancel their subscription before the next billing period.

Payments already collected for a new billing cycle are non-refundable, even if the client did not cancel the plan on time.

6. Client Responsibilities

You are responsible for providing accurate project information, files, and deadlines.

We are not liable for delivery delays caused by incomplete or incorrect information provided by you.

You agree to cooperate in good faith and provide all necessary materials and access required for the proper delivery of the service.

7. 90-Day CTR Guarantee

We offer a performance based guarantee designed to improve your channel’s click-through rate (CTR) through structured our thumbnail service.

Eligibility
This guarantee applies only to clients who:

• Provide access to YouTube analytics (viewer access)

• Consistently upload content in line with their selected monthly plan

• Use thumbnails and titles provided without external changes

• Follow the agreed A/B testing structure

• Have an average CTR of 4% or lower over the 28 days prior to onboarding

Upload Requirement
To qualify for the guarantee, the client must complete at least 80% of the planned uploads over the 90-day period, based on their active subscription plan.

Example:

• 2 uploads/month = minimum 5 uploads over 90 days

• 4 uploads/month = minimum 10 uploads over 90 days

Failure to meet this threshold may void the guarantee.

Baseline & Measurement
CTR improvement is measured against your channel’s average CTR over the 28 days prior to onboarding.

For eligible channels, our target is to double the baseline CTR within 90 days.

Performance is evaluated using YouTube CTR data, impressions, and A/B test results.

90-Day Period
The 90-day period begins once the first video using our thumbnails is published.

Guarantee Outcome
If we don’t double your baseline average CTR within 90 days, you can request double the thumbnails included in your monthly plan at no additional cost for the next 6 months.

Limitations

• Additional thumbnails are provided for a maximum of 6 months beyond the initial 90-day period

• Guarantee applies only while the client remains on an active plan

Exclusions
This guarantee does not apply if:

• The guarantee does not apply if the channel has insufficient data to complete A/B tests, including channels with fewer than 10,000 impressions in the last 28 days

• The guarantee is void if the minimum upload requirement is not met

• Thumbnails, titles, or tests are altered outside our process

• The guarantee is void if the client significantly changes content direction while working with us

• This guarantee applies only to click-through rate (CTR) improvement and does not guarantee specific views, revenue, or subscriber growth.

8. Intellectual Property

Upon full payment, you receive a non-exclusive, worldwide license to use the delivered creative works.

We reserve the right to showcase non-confidential works in our portfolio, website, and marketing materials.

If you prefer that your thumbnails are not used for promotional purposes, you may notify us at any time, and we will respect your request moving forward.

9. Limitation of Liability

Our liability is limited to the amount paid by you for the specific service.

We are not liable for direct or indirect damages resulting from the use of our service.

We do not guarantee viral results, only consistent, data-backed improvements over time.

Nothing in these Terms excludes or limits liability for damages that cannot be excluded under applicable law, including liability for willful misconduct or gross negligence.

10. Privacy and Data Protection

We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

By using our services, you agree to the collection and use of your data as described in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of Poland.

If you are a consumer based in the European Union, you may also benefit from mandatory consumer protection laws in your country of residence.

Any disputes shall be subject to the jurisdiction of the competent courts in Poland, unless otherwise required by applicable consumer protection laws.
